Terms of Use and General Terms and Conditions of Sale
These general terms are intended to inform any consumer of the conditions and modalities under which the company COSTALFA sells and delivers the ordered products, and to define the rights and obligations of the parties within the framework of the sale of products by COSTALFA to the consumer.
They apply, without restriction or reservation, to all sales of products offered by COSTALFA on its website. By placing an order, the Buyer acknowledges having read these terms and accepts them without reservation.
COSTALFA reserves the right to modify these terms at any time. The applicable terms are those in force on the date of the order (online publication).
Prices, costs and payment
The selling prices of products displayed on the COSTALFA website, expressed in euros, are those applicable at the time the order is recorded by the Buyer.
Prices do not include shipping costs, which are charged in addition depending on the order amount, nor any payment fees linked to the chosen payment method. These costs are indicated before final order validation.
COSTALFA reserves the right to modify its prices at any time. Products are invoiced based on the prices in force at the time of order confirmation.
The sale is considered final only after COSTALFA has sent an order confirmation email and has received full payment of the price.
In the event of payment by bank card, the order is valid only after confirmation by the banking institution. In the event of payment by cheque, the order is valid only upon receipt and clearance of the cheque. In the event of payment by bank transfer, the order is valid only after confirmation of receipt of funds on COSTALFA’s account. In the event of payment via PayPal, the order is valid only after confirmation by PayPal.
COSTALFA reserves the right to refuse or cancel any order in the event of an existing dispute with the Buyer, a payment incident, suspected fraud, or incomplete or inconsistent delivery information.
Product characteristics and availability
In accordance with Article L111-1 of the French Consumer Code, the Buyer may review the essential characteristics of the products on the COSTALFA website prior to placing an order.
Offers are valid while stocks last. For products not stocked, offers are subject to availability from suppliers. In the event of unavailability after the order has been placed, COSTALFA may propose a postponement, an equivalent product, or a refund.
Delivery – general rules
Products are delivered to the address provided by the Buyer at the time of order, within Europe.
The Buyer is solely responsible for the accuracy of delivery information. In the event of errors, incomplete details, or absence of the recipient, re-delivery or return costs shall be borne by the Buyer.
Delivery is made to a ground-level accessible location. No specific handling, upper-floor delivery, or installation is included.
COSTALFA shall not be held liable for delivery delays or impossibilities resulting from external events (strikes, weather conditions, logistical disruptions, force majeure) or circumstances attributable to the Buyer.
Timeframes
Timeframes are expressed in working days. A distinction must be made between dispatch times and delivery times.
In the event of a delay, a carrier investigation may be opened for a maximum duration of 21 working days. No replacement or refund may be claimed before the closure of this investigation.
Receipt – mandatory inspection
Upon receipt, the Buyer must:
- check the condition of the parcel in the presence of the carrier,
- record precise handwritten reservations on the delivery note,
- refuse delivery if the parcel is severely damaged,
- immediately inform COSTALFA customer service with evidence (photos, signed delivery note).
Statements such as “subject to unpacking” or equivalent have no legal value. In the absence of valid reservations, delivery shall be deemed compliant.
Claims
Any claim must be submitted in writing and must include the Buyer’s contact details, order number, product reference, and precise reasons supported by evidence. Failing this, COSTALFA may refuse to process the claim.
Returns and refunds
Any return requires a prior return authorization number. Products must be returned in their original condition and packaging. Return shipping costs are borne by the customer.
Risks related to returns are borne by the Buyer. Damaged or incomplete products may be refused or subject to depreciation.
Right of withdrawal
In accordance with applicable regulations, the Buyer has a fourteen-day withdrawal period.
Refunds will be made after receipt and inspection of the products or upon presentation of proof of shipment, whichever occurs first.
Retention of title
Products remain the exclusive property of COSTALFA until full payment of the price.
In the event of non-payment, COSTALFA reserves the right to reclaim the products at the Buyer’s expense and risk.
Transfer of risks
The transfer of risks occurs upon delivery of the products to the Buyer or to the carrier. Products travel at the Buyer’s risk.
Limitation of liability
COSTALFA’s liability is limited to the amount of the relevant order. COSTALFA shall not be held liable for indirect damages, loss of business, loss of revenue, or inappropriate use of the products.
These limitations apply within the limits permitted by law.
Warranties
Some products may benefit from a manufacturer’s warranty, independent of COSTALFA. COSTALFA shall not be held liable in the event the manufacturer refuses to apply its warranty.
Legal warranties
Products benefit from statutory warranties of conformity and against hidden defects in accordance with applicable law.
The company COSTALFA, whose registered office is located at 14 Op Den Drieschen L-4149 Esch-sur-Alzette, is the guarantor of product conformity.
Applicable law and jurisdiction
These terms are governed by Luxembourg law.
Any dispute shall fall under the exclusive jurisdiction of the courts of the Grand Duchy of Luxembourg, subject to mandatory consumer protection provisions applicable within the European Union.
